Q. How Can I Stop an IRS Levy on my Social Security or Social Security Disability (SSDI)?

You can stop an IRS Levy being executed on your Social Security or Social Security Disability (SSDI from going through by paying your back tax liability to the IRS IRS.gov) in a lump sum. Most people cannot do this when they have a limited income. If you decide to speak to the IRS on your own, you will be challenged by the IRS and you may be bullied into accepting an unrealistic payment plan that will fail. You have rights. Do not agree to any IRS payment plan without consulting with an experienced tax professional.

1. IRS Payment Plan: An IRS Payment Plan or IRS Installment Agreement may let you submit monthly payments to satisfy your back tax debt. There is a formula involved in arriving at the proper monthly payment due. The IRS will not tell you what that formula is. Do not enter into an IRS payment plan without consulting with a tax professional.

2. IRS Debt Settlement: An IRS Settlement for each taxpayer's circumstances. You may be able to pay your back tax debt for less than what you owe the IRS. You may be able to settle you back tax debt through the IRS Offer in Compromise program or you may dramatically reduce your IRS penalties through an IRS Penalty Abatement.

3.Currently Not Collectible (CNC): If you are absolutely unable to make any payments toward your IRS back tax debt (IRS.gov), the IRS may give you immunity from the collection process by placing you in a Currently Not Collectible (CNC) status. Currently Not Collectible is for taxpayers who cannot pay their back tax debt after all your monthly IRS allowable expenses are paid. See below for further details.

Federal Payment Levy Program (FPLP): Social Security or Social Security Disability (SSDI) benefit payments outlined in Title II of the Social Security Act, Federal Old-Age, Survivors, and Disability Insurance Benefits, are subject to the 15-percent IRS Levy, to pay your delinquent IRS tax debt if you do nothing.

Because the Federal Payment Levy Program (FPLP) is used to satisfy IRS tax debts, the IRS may levy your Social Security or Social Security Disability (SSDI) benefits regardless of the amount. This is different from the 1996 Debt Collection Improvement Act which states that the first $750.00 of monthly Social Security benefits is off limits to satisfy non-tax debts. Fifteen percent of the Social Security benefit will be levied through the FPLP regardless of whether or not the remaining benefit sent to you is less than $750.00.

Manual Levy: The IRS is not limited by IRC 6331(h) to taking 15% of your paycheck, your Social Security or your Social Security Disability (SSDI) benefits. The IRS can issue a manual levy that can continuously take ALL of your Social Security / Social Security Disability (SSDI) benefits as well as your paycheck / wage under Internal Revenue Code section 6331(a), which permits an IRS Levy on all your wage, salary or other income [which would include Social Security / Social Security Disability (SSDI)]. The 15% automatic IRS Levy provision is a supplement to the manual IRS Levy power. The IRS can choose the manual approach if it deems fit and attempts to collect more than the automated 15%.

If you are on Social Security or Social Security Disability, you do not have to suffer from an IRS Levy that takes most or all of your monthly check.
