The IRS (Internal Revenue Service) Collection Technicians (fancy title for "bill collectors") are professional debt collectors. Just because the IRS says that a certain dollar amount is owed in back taxes makes it necessarily so. Your back tax debt could be reduced dramatically in a variety of ways which is why you should consult with an experienced IRS Tax Attorney.

It is entirely possible for you to have an IRS wage levy stopped and release on your own. That fact cannot be denied. However, what you will not know, if you represent yourself, is whether you will be making the smallest IRS Installment payment possible, or, if you will be paying the smallest balance due and  what will be the correct amount of back tax debt. 
  1. You will not know if your tax returns should be amended which will result in less tax debt.
  2. You will not know if you are eligible and qualified to settle with the IRS for less than the amount of tax liability that the IRS is trying to collect.
  3. You will not know if you should file an IRS Offer in Compromise.
  4. You will not know if the penalties and interest that have been added to your tax debt can be eliminated and waived. This procedure is called a Penalty Abatement.
  5. You will not know if you can be declared Currently not Collectible.

An IRS Wage Garnishment is Typically Stopped and Released When:
  • When you pay the back tax debt in full. No kidding. If you had the money to pay your tax liability in full, you more than likely would have done so. So, let's move on.
  • The 10 year Statute of Limitations has expired. The Statute of Limitations is the collection time that the IRS has to collect your back tax debt from date of assessment. The Statute of Limitations can be tricky. The chances of the Statute of Limitations running out at the time of YOUR IRS wage levy, "slim and none."
  • You can stop an IRS wage garnishment and have the IRS levy released by entering into an IRS Installment Agreement. Most likely, you are going to pay "something" to the IRS. What needs to be determined is what the total amount of your back tax debt should be and what the amount of your monthly payment should be.
  • You could promise to pay the entire back tax debt in a certain period of time. If you try to do this yourself, you may be opening yourself to a myriad of questions regarding your finances. Remember this, the IRS has trained collection agents with vast powers and they will want and demand as much information about you as possible.
