The IRS has been easing up on financially struggling taxpayers and has expanded on their "fresh Start" program which allows unemployed taxpayers to put off paying their back tax debt for six (6) months with incurring stiff tax penalties.

There many options made available by the IRS to taxpayers that may be totally unknown to them. As with any IRS program, the are always limitations on taking advantage of them.

Do not ignore the IRS. If you are having a problem paying the IRS for a past due tax liability, you will only get yourself into deeper trouble by ignoring your IRS problem. 

YOUR IRS OPTIONS

PAYMENT POSTPONEMENT: If you have certain income criteria, it is possible to delay paying up to $50,000 in back tax debt until October 15th. To qualify, you must have been out of work for thirty (30) consecutive days either last year or this year. If you are self-employed and your business income plunged by more than 25% last year, you will also be eligible for this delay in payment.

Also, to be eligible your income must not be more than $200,000 if filing jointly or $100,000 if single and you file as head of household. 

Under the "Fresh Start" program, the IRS promises to waive to failure to pay penaly which is significant. The failure to pay penalty imposed by the IRS is 0.5% of the outstanding back tax liability per month and will not exceed a total of 25%. Interest will need to be paid which is now at a rate of 3%. Penalties on your outstanding back tax debt will start in mid-October.

To apply for the postponement, a taxpayer must file an IRS Form 1127A. This payment postponement is not automatic. Taxpayers applying for postponement must still file their tax return.

IRS INSTALLMENT AGREEMENT: The IRS made getting into a payment plan easier. Although the IRS has made it easier for a struggling taxpayer to enter into an Installment Agreement, that does not mean that the Installment Agreement is advantageous to the struggling taxpayer. Not to be disrespectful, but it does not take a great deal of knowledge to get yourself into a really bad Installment Agreement with the IRS. A taxpayer, who has financial problems, should 1st look at being declared Currently not Collectible and also at settling with the IRS for less through the Offer in Compromise program.

Before the IRS agrees to an Installment Agreement, a taxpayer will have to go through a burdensome process and reveal their finances to the IRS. A taxpayers idea of what is "necessary" expenses and what the IRS deems to be necessary expenses are vastly different. Our best advice to any taxpayer is to have an experienced IRS Tax Attorney negotiate with the IRS on all matters.

OFFER in COMPROMISE: When it is proven to the IRS that it is unlikely that a taxpayer's entire tax liability will be paid in full, a taxpayer may receive "tax forgiveness" through the Offer in Compromise program. 

The IRS has a complicated formula that must be navigated before the IRS will accept less than the entire back tax debt owed by a taxpayer. The IRS is in the business of collecting money and not in the business of "forgiving debt" but even the IRS must follow the rules.

The IRS will continually look to reject a legitimate Offer in Compromise on procedural issues. The IRS will scan every settlement offer to see if the "i's" have been dotted and if the "t's" have been crossed properly. If they haven't, the IRS will reject an otherwise legitimate Offer in Compromise as "non-processable." The IRS does not have to give a taxpayer a reason for the rejection. 

Since February of 2011, the IRS has eased up on the requirements for eligibility in the Offer in Compromise program. The IRS has named this easing as "Streamlined Offer in Compromise." A taxpayer can now earn up to $100,000 and owe less than $50,000 in tax debt and be qualified. 

Due to the economic times that we live in, the IRS has placed in a position where they have to accept more settlements through the Offer in compromise program. The key to a successful Offer and one that is not successful is the preparation. Are the documents prepared correctly so that the taxpayer's Offer is not rejected for clerical errors? Is the taxpayer's Offer in Compromise proposal prepared according to the IRS financial formula? Is the taxpayer's settlement Offer "right on the money?" Your Offer in Compromise needs to be "right on the money" or it will be rejected and the IRS will proceed to pressure you, the taxpayer, through enhanced enforcement.

WHAT IS THE IRS NOTICE CP 91 - 

The Cp 91 IRS Notice is comparable to the CP 90 IRS Final Notice. The CP 91 IRS Notice can be used by the IRS as the final notice prior to the IRS placing a levy on a struggling taxpayer's Social Security benefit. Under the Federal Payment Levy Program, the IRS can and will levy (garnish) a taxpayer's Social Security or Social Security Disability payment if the taxpayer owes a back tax debt that is no less than 1/2 year (6 months) old. If you do nothing and you do not have an experienced IRS Tax Attorney involved in having the IRS Levy stopped and released, you should expect the IRS to take / seize 15% of your Social Security check.

If you have unfiled / delinquent tax returns, the IRS can take 100% of a taxpayers income through what is called a Manual Levy.

HOW SERIOUS IS THE IRS CP 91 NOTICE



A CP 91 is a FINAL NOTICE. It does not get any more serious than this. Final means Final. There will not be any more notices or warnings coming from the IRS. The next step is to seize your money.

HOW DOES THE IRS KNOW IF YOU RECEIVE SOCIAL SECURITY

The IRS has a computer system that is used for enforcement and collection of back tax debt. This IRS computer system is called the Automated Collection System (ACS) and it "talks" to another computer system used by the Federal Government and this computer system is called the Financial Management System (FMS). The Financial Management System keeps track of every check that the federal Government issues which includes Social Security as well as Social Security Disability (SSDI). These separate computer systems match data and it's only a matter of time before the IRS has a levy placed on your Social Security benefit. 

SOCIAL SECURITY LEVY PROBLEMS

Once the IRS has the Levy attached to your Social Security benefit, there are issues regarding the removal or release of the IRS Levy. The biggest problem is this: You, the struggling taxpayer, will be dealing with one (1) computer talking to another computer. This means that even if you are lucky enough to have your levy stopped and released, you may still lose an additional check because of when the two (2) computers "talk" to one another. It all depends on "the time of month" that the levy release is received by the Financial Management System (FMS) computer from the IRS Automated Collection System (ACS) computer and when the taxpayers check is scheduled to be sent. So a taxpayer needs to be aware of this.

ONCE THE IRS LEVY IS STOPPED

AND RELEASED

WHAT THEN?

A struggling taxpayer, who has a back tax debt and is receiving Social Security or Social Security Disability (SSDI) has several options and they are:
  • Enter into an Installment Agreement with the IRS. The IRS will continue to add penalties and interest and the taxpayer with the limited income will be paying a lot more than their original tax liability. This isn't necessarily the best idea.
  • The struggling taxpayer may placed in Currently not Collectible status. This means that the taxpayer will not make any payments toward their back tax debt as the Statute of limitations continues to run out. The IRS will periodically check on the income and asset status of the taxpayer who is Currently not Collectible. 
  • Settle with the IRS for less than the full tax liability. The IRS offers struggling taxpayers a settlement (forgiveness) program called an Offer in Compromise. Not everyone is eligible and qualified. The IRS has a complicated formula to determine whether or not a taxpayer can settle for less than their tax liability. There are many complications associated with a successful Offer in Compromise and it is not recommended that a taxpayer handle their own settlement offer.

What is IRS Tax Debt Forgiveness?

The IRS is a very powerful collection agency who has the responsibility for collecting Federal Income Tax. The IRS is not a "consumer protection agency" and it isn't their responsibility to fix your back tax problems. Your back tax problems are your responsibility and the IRS will only act when presented with information provided by the indebted taxpayer.

The IRS does not "forgive tax debt." A taxpayer's back tax debt can be reduced and settled through various methods but it is never "forgiven." Here are the various ways that a taxpayer can have their back tax debt reduced and or "forgiven:"

Penalty Abatement - The IRS will adjust the penalties and interest assessed to a taxpayer's back tax debt due to what is called "reasonable cause." The taxpayer needs to petition the IRS for a Penalty Abatement based on a reasonable cause. A reasonable cause for a taxpayer's IRS problem can be many things, including: loss of job, loss of income, health issues, death to a family member, forces of nature, bad tax advice, bad advice from the IRS, divorce, etc.

When you petition the IRS for a Penalty Abatement, you get only "1 bite at the apple." You get one (1) petition and that is it, so it had better be prepared right the first time. Most likely, an inexperienced taxpayer will not know what they are doing and they will fail. If you do a Penalty Abatement, be sure to have an experienced IRS tax professional prepare your Penalty Abatement petition.

File Your Delinquent Tax Returns - If you have tax returns that are unfiled and delinquent, you are being assessed penalties and interest that is quite frankly "ought of sight." Besides the enormous penalties and interest that are being assessed to your back tax debt because you have not filed your tax returns, you have no Rights. The IRS does not have to negotiate with you. The IRS can seize your paycheck, your Social Security, your bank account(s) and take your car or other assets that has value. 

By filing your delinquent and unfiled tax returns, you will restore your rights and you it is possible to have those egregious non-filing penalties reversed out. This can mean an enormous savings from what the IRS has been trying to collect from you. Also, if you are compliant (all necessary taxes have been filed), you can then be eligible for other forms of tax debt reduction or "forgiveness."

Currently not Collectible - If you do not have the ability to pay the IRS anything, you may be placed in Collectible Status which is formally called, Currently not Collectible. Like anything else with the IRS, you will be required to file an application. For individuals the application is called a 433-A. For a business, the IRS application is called a 433-B. Both the 433-A and the 433-B IRS Forms are financial statements listing income, assets and expenses. If you or your business are struggling financially and show this on your 433-A or 433-B form, all IRS collection activity against you or your business will cease (stop). Your bank account(s) will be protected from IRS seizure. Your wages (paycheck) will be protected from an IRS wage levy (garnishment). Your Social Security will be free from an IRS levy. Now, understand this, your debt is not "forgiven," but you will not be making payments on your back tax debt. 

Thew IRS will periodically check in with you and you, currently not collectible taxpayer, will be required to show the IRS that you are still unable to pay back your tax liability. The Statute of Limitations will continue to run out while you are in uncollectible status. In effect, you may never pay the IRS "one thin dime" toward your past due tax debt. The IRS will, most likely, file a Federal Tax Lien against you. If you have a refund coming, the IRS will seize it and apply the tax refund toward your back tax debt. That is a small price to pay when you consider that your back tax debt, which could be tens of thousands of dollars, will never be paid. Once again, being Currently not Collectible is not a "forgiveness" of your back tax debt but it is a significant IRS program that will reduce your tax liability.

Offer in Compromise (Fresh Start Initiative) - An IRS settlement of a tax debt is not "forgiveness." Remember, th IRS doesn't "forgive" debt. What the IRS will do is this: the IRS will settle for less than the amount owed. An IRS settlement (forgiveness of debt) is based on a very complicated formula. This settlement formula is based on a struggling taxpayer's income, their assets and what is called allowable expenses. It is similar to being declared Currently not Collectible except the taxpayer in this case can the IRS "something." What this "something" is will more than likely be beyond the comprehension of the ordinary taxpayer. 

An "IRS forgiveness" through the Offer in Compromise program is based on three different reasons:
  1. Doubt as to Collectibility - This is when the IRS believes that it is highly unlikely that the entire amount of tax liability will ever be repaid within the Statute of Limitations. The struggling taxpayer has the ability to pay "something." The amount negotiated does not have to be paid in a lump sum. A struggling taxpayer can pay the IRS back in monthly installments.
  2. Doubt as to Liability - Approval for an IRS settlement under Doubt as to Liability is rarely granted. A taxpayer has to prove that the IRS made a mistake or error. Good luck with that one. 
  3. Effective Tax Administration - When a taxpayer admits that the tax debt is valid and also has the assets to pay the delinquent tax debt, the IRS may accept a settlement from the taxpayer based on a "hardship." More than likely the only taxpayer that will have this form of "tax forgiveness" granted would be an elderly couple with limited income but have a home that has some equity. Once again, good luck with this one.
It comes down to this: the struggling taxpayers ability to pay the IRS against the IRS's ability to collect. Doubt as to Collectibility is the #1 reason why an Offer in Compromise is accepted. To be clear, a successful Offer in Compromise is not "forgiveness" of a tax liability. An Offer in Compromise is an agreed upon settlement of a delinquent tax liability. 

What is Expected of a Taxpayer who has a Successful Offer in Compromise:
  1. The taxpayer's tax returns must be filed on time (April 15th) for a period of 5 years. You will be on "IRS tax probation." Failure to file your tax returns will result in reinstatement of the original tax debt plus additional penalties and interest.
  2. A taxpayer must pay any taxes due at the time of filing. Failure to do so will result in reinstatement of the original tax debt plus penalties and interest.
  3. The agreed upon monthly payments for the accepted Offer in Compromise must be paid timely. Once again, failure to do so will result in reinstatement of the original back tax debt plus additional penalties and interest.
DOES ANY OF THE ABOVE SEEM LIKE "FORGIVENESS" TO YOU?

As stated previously, the IRS does not "forgive" debt. The IRS must allow a Penalty Abatement when it is proven that a taxpayer had reasonable cause for their problem. The IRS must place a taxpayer in Currently not Collectible status when shown that the struggling taxpayer cannot pay anything toward their delinquent tax debt. The IRS must accept an IRS Settlement when shown that a struggling taxpayer can only pay the offered settlement. 

The IRS will always look for ways to reject any settlement offer. The IRS will not "go quietly into that good night." The IRS will look to see if you failed to "dot an "i" or "cross a "t." When the IRS rejects an Offer in Compromise because the form has an error of some kind, the IRS calls this "unprocessable." The IRS will not give you a reason for the rejection. It's up to the struggling taxpayer to "figure it out."

IRS NOTICE OF  INTENT TO LEVY

The IRS will be relentless in pursuing you for the back tax debt that is owed. When you owe back taxes to the IRS, your financial future is in jeopardy. The IRS will send you a "Notice of Intent to Levy." For a Notice of Intent to Levy to be enforceable, the IRS only needs to mail it out. The IRS can mail it to any address that they may have for you, so you may never actually receive it. Once a Notice of Intent to Levy has been sent you can be sure that a Federal Tax Lien will be recorded against you and all of your property. You should also expect the IRS to seize your bank account(s) and your paycheck. The Notice of Intent to Levy will be sent certified mail but as we wrote previously, you do not need to have received it. Once it is sent out, you, the delinquent taxpayer are "fair game" for IRS enforcement. You will need an experienced IRS tax relief team led by an IRS Tax Attorney to secure your Rights and negotiate with the IRS.

IRS WAGE GARNISHMENT

If you are about to have your wages be garnished or levied by the IRS, an experienced IRS Tax Attorney can have your IRS wage garnishment (a/k/a IRS Levy) lifted (stopped, released and removed)  and will work with the IRS for a tax relief program that is best for you. An "experienced" IRS Tax Attorney is a Tax Attorney who routinely engages with the Enforcement Division (Collection Division) of the IRS. 

Be advised that the IRS has very strict guidelines and protocols which determine how much of your paycheck / wages will be seized and applied to your back tax debt. The loss of any amount of money from your paycheck will be devastating. In certain cases, the IRS can take your entire paycheck by enforcing what is called a Manual Levy.   • Taxpayers should find it easier to obtain a lien withdrawal one a back tax debt is paid.
  • The IRS will withdraw a tax lien, in most cases, when a taxpayer enters into a Direct Debit Installment Agreement.
STREAMLINED OFFER in COMPROMISE PROGRAM

The new Streamlined Offer in Compromise Program includes:
  • The IRS will have fewer requests for additional information.
  • Should it be necessary, the IRS will request additional by phone and not by mail.
  • The IRS will allow greater flexibility when considering a taxpayer's ability to pay their back tax debt.
Qualified Taxpayers for the Streamlined Offer in Compromise Program are:
  • Wage Earners
  • Unemployed
  • Self Employed taxpayers who have no employees and gross receipts under $500,000.00
Streamlined Offer in Compromise Eligibility Requirements:
  • A struggling taxpayer has a total household income of $100,000.00 or less, 
  • The amount of back tax debt is less than $50,000.00 at the time that your Streamlined Offer in Compromise is filed.
THE OFFER in COMPROMISE:

An IRS settlement through the Offer in compromise program allows a struggling taxpayer to settle their back tax debt for less than the entire amount of the tax liability. An Offer in Compromise is a legitimate option when a taxpayer cannot pay the entire amount of the back tax debt. IRS collection enforcement would create a financial hardship on the taxpayer.

The IRS will consider a struggling taxpayer's unique set of facts and circumstances. These include:
  • A taxpayer's ability to pay.
  • A taxpayer's income.
  • A taxpayer's expenses.
  • A taxpayer's asset equity.
THE IRS EMPLOYS A COMPLICATED FORMULA REGARDING AN 

OFFER in COMPROMISE


The IRS will generally approve an Offer in Compromise when the settlement amount offered by a struggling taxpayer represents the largest amount that the IRS can expect to be paid within a reasonable amount of time. You can expect the IRS to pressure you into accepting an ill advised Installment Agreement.

WHAT IS IRS INCOME TAX RELIEF?
