New IRS rules has made it easier to settle a taxpayer's back tax debt and eliminate, not only the penalties and interest, but much of a taxpayer's principle tax liability. The Internal Revenue Service (IRS) has expanded their Fresh Start settlement program through the easing of the eligibility and qualification rules regarding an Offer in Compromise.

Below are four (4) "tips" that should explain to you, the struggling taxpayer, how it may be possible to find tax relief and obtain a fresh start for yourself. The egregious IRS Penalties are one of the biggest burdens a struggling taxpayer faces when they are trying to resolve a delinquent tax bill. The IRS' Fresh Start Penalty Relief Initiative can give a qualified taxpayer a six (6) year extension to fully pay their 2011 tax debt. Interest will still apply and accumulate from April 15, 2012 until the tax debt is paid in full, but a taxpayer will not  have "failure to pay" penalties if the tax debt is paid by October 15th, 2012.
  1. IRS Penalties - The penalty relief portion of the IRS fresh start initiative relieves some unemployed taxpayers from the "failure to pay" penalties. Penalty relief is available to wage earners who have been unemployed at least 30 consecutive days during 2011 oir 2012. To qualify you must not exceed $200,000 in income if married filing jointly or $100,000 if filing single, married filing separately, head of household or qualifying widow/widower.
  2. Installment Agreement - The IRS term for a payment plan is the Installment Agreement. The Fresh Start Initiative gives a taxpayer the ability to use a streamlined installment agreement to pay their tax debt. The new threshold for requesting an installment agreement has been raised to $50,000 from the previous $25,000. A Streamlined Installment Agreement requires limited financial information which means there is less burden on the taxpayer entering into a payment plan with the IRS. The maximum payment term for a streamlined installment agreement has been raised from the previous five (5) year agreement to the present six () payment plan. If your tax debt is more than $50,000 you will need to complete an IRS Collection Information Statement (IRS Form 433-A or IRS Form 433-F). To qualify for a streamlined installment agreement, a taxpayer will have to agree to direct debit payments. A taxpayer could go to the IRS.gov website and agree to a payment plan by bringing up the On-line Payment Agreement (OPA) page. PLEASE NOTE: Yes, you can enter into a payment plan with the IRS "all by yourself" but our IRS tax relief team at Flat fee tax Service, Inc. doe not recommend that.   3. Offer in Compromise - The IRS in 2011 came out with their Fresh Start program which expanded a taxpayer's ability to settle their back tax liability. The 2011 IRS Offer in Compromise Fresh Start program expanded settlements to cover a larger group of struggling taxpayers. In 2012, the IRS has been dragged, kicking and screaming, to face the current realities facing the taxpayers of the United States. The IRS has further expanded the Fresh Start program. A financially struggling taxpayer would be silly and foolish not to look at settling with the IRS. A successful Offer in Compromise will settle a tax debt and give you a new lease on life. An Offer in Compromise is a settlemenet agreement between the IRS and a taxpayer that will settle the taxpayer's tax debt for less than the amount owed. It's no secret that taxpayers are struggling financially during this economic downturn. As previously written, the IRS has been forced to recognize that taxpayers continue to struggle to pay not only their tax burden but their everyday living expenses. As an example, the IRS now considers credit card payments as well as student loan payments when calculating an Offer to settle. Although the IRS has adopted some "common sense" changes to their Offer in Compromise program, make no mistake and forget that the IRS is still is the most powerful collection agency in the world. The primary job of the IRS is to collect as much money as quickly as they possibly can, as quickly as they can. IRS Levy on Social Security - Federal Payment Levy Program

What is an IRS Levy?

An IRS Levy is a legal seizure of a taxpayer's property to satisfy a back tax debt that is owed to the federal government. A struggling taxpayer who has outstanding IRS tax debts are subject to the IRS executing a levy (garnishment) on income and assets.

If you, the struggling taxpayer, are subject to the levy, the IRS will send a notice to you. The notice will be a Notice of Intent to Levy and does not have to be received by the taxpayer. The IRS is only obligated to send the Notice of Intent to Levy to the last known address in its system.

A taxpayer has 30 days from the date of the notice to either pay the back tax debt or contact the IRS. If you fail to do either of these two (2) options, the IRS is allowed to levy (garnish) on your income, your assets and/or your Social Security.

Once an IRS Levy is in place, the IRS may withhold monies from the federal payments a taxpayer may receive. An IRS levy is considered to be continuous and the IRS will keep taking your money until the taxpayer's entire back tax debt is paid in full, a payment arrangement or Installment Agreement is made or the debt becomes unenforceable by law.

What Is A Levy On Social Security Benefits?

All taxpayers who owe the IRS for an outstanding tax liability will be subject to a levy on their assets which includes their sources of income. A taxpayer's Social Security benefit is subject to a levy by the IRS. There are 2 ways the IRS will place a levy upon your Social Security check:

  • The Automated Federal Payment Levy Program  (FPLP) - The IRS will match up your Social Security number that is on file in their Automated Collection System (ACS) with the federal government's computer that sends out checks which is called the Financial Management System. The IRS will take a minimum of 15 percent of a taxpayer's Social Security check each and every month or until the levy has been stopped and released.
  • Manual Levy(non-FPLP) - Using the Manual Levy, the IRS has no restrictions as to the amount that they can take from a taxpayers wages or Social Security. All it takes is the signature of the Revenue Officer to get the Manual Levy in place. The IRS is supposed to take into account money the taxpayer will need for what is called "reasonable living expenses." Let's just say the IRS' idea of reasonable living expenses and realty are usually very far apart. The IRS will leave you with very little if any money at all.
An IRS levy on a taxpayer's Social Security will include the following: retirement benefits, survivor payments and disability insurance program payments (SSDI).

The IRS cannot levy on the following: children's benefit, supplemental security income payments and lump sum death benefits.

What If A Taxpayer Cannot Pay The Back Tax Liability?

If a struggling taxpayer cannot pay their back tax debt, there are avenues available to them:
  1. You can send the IRS the balance in full. Now, if you are a taxpayer experiencing financial difficulty, this probably isn't an option for you.
  2. A taxpayer could call the IRS and enter into a terrible payment plan. Our IRS tax relief team does not recommend this because a taxpayer will end up agreeing to go along with whatever the IRS Agent says they must do. This is the least desirable option a taxpayer can make.
  3. A taxpayer who is having a hard time making ends meet may be declared to be "Currently not Collectible" (CNC). When a taxpayer is declared to be Currently not Collectible, it is because there is a financial hardship and the struggling taxpayer will not pay anything. Yes, penalties and interest will continue to be added to the tax debt. Yes, there will be a Tax Lien filed. But, in all honesty, who cares? The Statute of Limitations will continue to run out and your Social Security benefit will be left alone.
  4. A taxpayer can settle with the IRS for less than the full amount. The IRS has expanded its Offer in Compromise program. The new and expanded rules for an IRS settlement is called the Fresh Start program. If the Offer in Compromise is done correctly, a taxpayer can settle for much less than he or she owes. Also, the agreed upon settlement can be paid over time so a taxpayer does not have to come up with a lump sum payment. If you are on Social Security and have limited or no assets, you would be silly not to take advantage of the IRS Fresh Start Offer in Compromise program.

The IRS will rely on the National Standards Program to assess your current financial condition.
  • Installment Agreements: The IRS will try and have you agree to a monthly payment plan in order to close your case. These payment plans are called Installment Agreements. Never, ever, agree to an IRS Installment Agreement prior to consulting with a seasoned IRS Tax relief professional who has years of negotiating with the IRS. Any "knucklehead" can agree to a payment plan. The idea is to have your tax debt reduced to its lowest amount and then agree to an Installment Agreement.

The IRS has named their new set of eligibility requirements as the Fresh Start Program. The IRS Fresh Start Offer in Compromise program has increased the amount of income you can earn. The IRS will also take into account your credit card and student loan debt when calculating your settlement. IRS Offer in Compromise Rules: The IRS may accept your IRS settlement through the Offer in Compromise based on 3 grounds:
  1. Doubt as to Collectibility: The IRS has doubt that you, the taxpayer, could ever pay back the full amount of tax liability prior to the Statute of Limitations running out. Doubt as to Collectibility is the most common practice to settle with the IRS.
  2. Doubt as to Liability: A legitimate doubt exists that the assessed tax debt is correct. Possible reasons to submit a doubt as to liability claim would be if (1) the examiner made a mistake interpreting the law; (2) the examiner failed to consider the taxpayer's evidence; (3) you, the taxpayer, has new evidence. Forget this one. It is very rarely granted. Concentrate on Doubt as to Collectibility.
  3. Effective Taxation Administration: Effective Tax Administration or Exceptional Circumstances is when there is no doubt that the tax is correct and there is potential to collect the full amount of the tax liability, but an exceptional circumstance exists that would allow the IRS to consider an Offer in Compromise. For a taxpayer to be eligible for a compromise based on Effective Tax Administration, it must be demonstarted that the collection of the tax would create an economic hardship and the tax debt would be unfair and inequitable. Once again, forget this one and go with Doubt as to Collectibility.

This "exemption" will not be much and will leave you with very little to live on. Also, the IRS may take your entire check through what is called a Manual Levy. A Revenue Officer can sign off on a Manual Levy and take anything that they want.

Can the IRS continue, on an ongoing basis, seize my paycheck?

Absolutely. Unless steps are taken, the IRS will continuously levy your paycheck until the entire back tax debt is paid in full. The IRS will not cease collecting on a levy until a collection hold has been placed on your case and the IRS will then fax a 668-D levy release.
