Recent IRS Income Tax Scams You Should Know About - Info Brought to You By Flat Fee Tax Service

Scam artists are always on the lookout for ways to get your financial information. So-Called "IRS Phone Calls"

The latest scam on taxpayers is this: a taxpayer, who probably has a Federal Tax Lien, will receive a phone call from someone who claims to be from the IRS. These scam artists will try and scare the taxpayer into paying money over the phone or face "deputies" being sent to their home for arrest. The IRS does not make calls like these. EVER!!!! IT"S A SCAM.

If you receive a call like this, you can hang up on them without fear of being arrested, or, you can report this scam to the authorities. Either way, DON'T WORRY ABOUT IT.

Free Tax Preparation Emails

Many tax preparation companies advertise free federal filing promotions each tax season. Not surprising is that email scammers have used those promotions to fool people into handing out their personal information. The latest scam involves an email offer for free tax help, and requests taxpayers provide a wealth of personal and financial information. Instead of using that information to prepare a tax return, the scammer steals your information in order to rob you blind. If you are going to file your return online, make sure you are doing so through a trusted and secure site, not one that sends you a scamming email advertisement.


W-2 Scam


Recently, the Better Business Bureau issued a warning about a new scam wherein a taxpayer is asked to provide information from their W-2 online. Please remember, the IRS will not contact you via email to ask for personal information. W-2 forms are submitted by employers, not prepared by taxpayers. If the IRS truly has questions about your tax forms, they will send you a letter through the mail.
 
EFTPS Payment Emails


Another new email scam, that bloggers began noticing at the start of 2010, is an email claiming to be from the IRS regarding the Electronic Federal Tax Payment System (EFTPS). Although the links did eventually forward you to the EFTPS site, they first went through a redirect that would install spyware on your computer. Of course, with the spyware installed on your computer, as soon as you entered any personal and financial information into the EFTPS, the scammer had everything they needed to steal your identity and your hard earned cash. 


Treasury Department Requests


Although this one may seem obvious, you should always ignore emails from senders claiming that you are being awarded a refund or tax inheritance. These emails sometimes claim they are contacting you on behalf of the Treasury Department and need you to provide banking information in order to get the funds. Please remember, that government entities will not make their first contact with you an email.
 
How to Avoid Tax Scams


It is easy to avoid becoming the victim of tax related identity theft if you follow these 3 basic rules:
1. Do not open any attachments in emails from groups claiming to be the IRS, or offering free tax advice. If you are interested in an advertisement that shows up in your inbox, contact the company over the phone.
2. Do not reply to any emails with personal tax or financial information about yourself. The IRS will never request information such as your social security number, or any financial information, through an email. As a general rule avoid doing business with any company asking you to send personal information via email. Even if the company is legitimate, emailing sensitive information poses a serious security risk. A
3. Do not click any links from organizations you do not recognize. Even if the link appears to be from the IRS. 


How to Report Questionable Emails


If you get an email that you think might be part of a tax scam, you should send it to the IRS to investigate. Simply forward it to phishing@irs.gov, and delete the message from your inbox.

TOP TIPS -- Top Tax Breaks for Entrepreneurs -- You and the IRS

If you haven’t filed your business tax return yet, now is the time to kick it into high gear. To help you finish strong, here are more valuable business deductions to help you save money on your taxes.

Taxes Paid

Let’s start with my personal favorite: TAXES. Yes, most entrepreneurs are able to deduct taxes they pay in operating their businesses. That being said, there are some rules for how and when to deduct:

  • Sales taxes paid for business purchases should be deducted as part of the cost of the total item. This holds for all your normal day-in/day-out business purchases – think: supplies. As for larger purchases, a company car, these are capital expenses, and the taxes are added to the car’s cost basis, which is deducted over several years.
  • Employment taxes paid for your employees are deductible as a business expense. If you are a sole proprietor or self-employed, your self-employment taxes are deducted on your personal tax return, not your Schedule C.
  • If you pay real estate taxes for property used for business, you can deduct those taxes.
Auto Expenses

New business owners are known for putting in some serious drive-time. Most of us think “mileage” when talking about deducting auto expenses, but if you have a newer car primarily for business purposes, you might be better off going the actual expenses route. Instead of tracking miles, you track the actual expenses of operating and driving your vehicle, and that means you can deduct depreciation. Work with your tax professional to find out which method works for you, because once you choose, it can be a hassle to switch.

Starting a Business

If you started a new business in 2010, first, Congratulations! Now, you need to think about deducting the expenses associated with starting a business. Amounts you paid for advertising, supplies, repairs, utilities, etc, prior to opening your doors are deducted as capital expenses. This means there is a cap on how much you can deduct. In 2010, you can deduct up to $10,000, with any remaining amounts deducted over 15 years. Of course, once your doors are open, those costs are deducted as business expenses.

Business Interest

No business can operate without credit, but that credit comes at a cost: interest. Lucky for entrepreneurs, interest incurred for business purchases is 100 percent deductible. So hold on to your credit and loan statements, and deduct the amount of interest you paid in 2010.

Bad Debts

We must also discuss a harsh reality in these tumultuous economic times: bad debts. I think we have all been there, people who order, but never pay. It can take slim profit margins and reduce them to nothing. Fortunately for some, if your business sells actual goods, you can deduct the cost of the items that sold, but were never paid for. On the other hand, if your business is a service, there is no deduction allowed for bad debts. Bummer, but perhaps that little nugget of information can prompt you to evaluate your payment terms and get at least part of the sale up front.

New Equipment

If you purchased new equipment for your business in 2010, you may be able to write off the entire cost this tax season. How? Section 179, baby! I have written about this invaluable tax break before but the basic idea is that you may be able to deduct up to $250,000 of the cost of new equipment that was put into service by December 31, 2010. There are restrictions and phase outs, but for small business owners who made significant capital expenditures last year, this deduction can be a life saver.

What if you purchased some expensive software last year? Generally, you are required to depreciate the costs of business software over 36 months. However, lucky for you these costs are eligible for the Section 179 deduction, so long as it was purchased and placed into service as of December 31, 2010. This includes any software that came with a new computer system, or was purchased separately.

Charitable Contributions

If your business is an S corporation, an LLC or a partnership (in other words, a pass through entity), the business can make charitable donations, and pass the deduction on to you. This includes gifts of cash, or donated office supplies, like computers and desk chairs. If your business is a regular C corporation, the company can take the deduction itself. There is a caveat here, however. If you donate office furniture or computers, and they have been fully depreciated, your business will not receive a deduction. You can still donate and enjoy the sense of good will, but there is no tax benefit. Either way, it pays – in either tax breaks, or community appreciation – for your business to be charitable.

Advertising and Promotion

There is a quote credited to advertising legend Stuart Henderson Britt, “Doing business without advertising is like winking at a girl in the dark. You know what you are doing, but nobody else does.” In other words, your business may be exactly what someone needs, but if you are not advertising, they will never find out about you. Because advertising and promotion is so crucial to your business, those costs are all deductible. Remember to keep track of all your advertising expenses, including the costs for designing and producing any advertising, and the costs for placing those ads.

IRS Problems -- Why Do People Have IRS Income Tax Problems and Income Tax Debt

But what would Ben Franklin have said about the tax gap, the difference between the amount of tax due to the federal government and the amount taxpayers actually pay?
This year it’s likely to approach $300 billion, or nearly 15 percent of federal revenues. All told, as many as 30 to 40 percent of Americans won’t pay all of the taxes they owe in 2015.
What’s going on here? Why and how are so many people avoiding what Franklin thought was a certainty?
Much of the gap is the result of good faith mistakes by taxpayers — no surprise given the mind-numbing complexity of the tax code.

But some significant part of the disparity is the result of intentional  evasion, non-payment, or underpayment. The question is why.  Why are so many Americans willfully and flagrantly violating our tax laws?

The issue is a complex one, but a few key factors can be identified. One is that the norms associated with the duty to pay income taxes are surprisingly weak. Most scholars agree that society’s ability to enforce compliance with the law lies less in the government’s power to impose sanctions than it does in the norms by which people direct their lives.

Generally speaking, people refrain from committing crimes not because they fear sanctions if they do, but because they believe it is morally wrong to engage in the conduct prohibited. In the case of paying taxes, lots of people apparently believe it’s not morally wrong to fail to pay what’s owed. Suspicion of taxes is deeply rooted in our national psyche, going back to the Boston Tea Party of 1773 and the Whiskey Rebellion of the early 1790s.

In the current political climate, taxes have been so demonized that many citizens regard taxation itself as wrongful. And if people believe that taxation itself is wrongful, then it would seem to follow that such people would also believe that the failure to pay taxes is not wrongful.

There is also a widespread belief among many citizens that others in the community — both their neighbors and their leaders — are failing to pay the taxes they owe. And, to some extent, they’re correct. (For example, none other than former Treasury Secretary Timothy Geitner admitted that he failed to pay $34,000 in Social Security and Medicare taxes while employed at the International Monetary Fund.)

If people really believe that “everyone else is doing it” – that everyone else is failing to pay the taxes they owe — it’s no wonder they think it’s okay for them to do the same thing.
Many also believe that the tax code is unfair and that tax revenues are being used for unwise purposes.

Whether one is a liberal who thinks that more of the tax burden should be shouldered by the very rich, or a conservative who believes that the government shouldn’t be in the business of supporting the poor, one is likely to be dissatisfied both with the formula that determines who pays what, and with what our government decides to spend the money on.

In such an environment, it’s not surprising that some people would believe that non- or under-payment of taxes is not only not wrongful, but is actually justified.

Perhaps the most significant factor that explains the yawning breadth of the tax gap, however, is that our system of enforcing the tax laws is inadequate and uneven. According to the IRS’s Citizen Oversight Board, the agency is so understaffed and underfunded that it simply can’t keep pace with increases in tax evasion. Less than two percent of all returns are ever audited, and only a tiny fraction of tax evaders are ever subject to criminal investigation or prosecution.

With respect to the nation’s largest corporations (those reporting assets of $250 million or more), the IRS has, since 2005, sharply reduced both the number of audits conducted and the amount of time it spends on each audit. There are also serious geographical disparities in tax enforcement: Residents of California, for example, are much more likely to be audited and prosecuted than residents of the New York metropolitan area. Such irregular enforcement practices not only leave potential tax dodgers undeterred, but also send a message that the obligation to pay taxes is not really that important.

None of us, of course, actually likes to pay income taxes, and there is no shame at all in trying to reduce one’s tax liability by all means legally permissible. Moreover, none of us would want to live in a society in which the IRS was constantly peering into our most private business affairs.

Still, tax revenues are the fuel that keeps the engine of government running, and it’s essential to our democracy that everyone do their part to help pay the debts our society collectively incurs.

We should resolve to create a tax system that is fair enough both in its substance and in its enforcement that more citizens will feel an obligation to pay their taxes.

Installment Agreement: Taxpayers can always consider entering into a payment plan with the IRS. The IRS will label a taxpayers as compliant when entered into an Installment Agreement. The amount of IRS notices will be reduced. The IRS will consider the case closed with a resolution.

When to use an Installment Agreement: The easiest way to answer that question is to find when a taxpayers should not enter an payment plan. If you, the struggling taxpayer, has a large income tax debt and you can only afford the minimal installment payments another option may be more desirable. 

Installment Agreement Pros:  The IRS will be content so you won't have "that problem." The IRS won't send you any more threatening notices. 

Installment Agreement Cons: Interest and penalties all continue to increase. Your income tax debts will take years to pay off. If you default, the IRS will levy you.

ANYONE CAN GET THEMSELVES INTO A BAD IRS INSTALLMENT AGREEMENT 

File and/or Amend your Income Tax Returns: A taxpayer  can lower their income tax debt by having an experienced tax preparer file an amended income tax return. A taxpayer can also engage an experienced and reputable tax preparer file your income tax returns that are missing. The penalties for non-filing can be reversed and eliminated if done correctly.

When to Use: Filing an amended or missing income tax return should always be used because of the direct reduction in your income tax liability. If you have not filed an income tax return, the IRS can file what is called a "Substitute for Return" which is not a tax return. The IRS will give you minimal deductions and exemptions. The IRS will pile on penalties for non-filing.

Pros: Decrease in your income tax liability. Potential penalty and internet abatement.

Cons: Takes extensive knowledge of the Income Tax Code. Takes extensive knowledge of the Statute of Limitations. 


Offer in Compromise: The IRS, several years ago, expanded the eligibility requirements for the Offer in Compromise program. The expansion is called the Fresh Start Initiative. If you are struggling to make ends meet, this is, most likely, the way for you go. The IRS has a complicated financial formula that takes into account your assets, monthly income and expenses.    

When to use the Offer in Compromise: When a taxpayer is struggling financially. Has few if any assets. Taxpayer must be compliant with their tax returns. That means you have no delinquent returns.
