In a report to Congress, the National Taxpayer Advocate stated that in "Vinatiery, 133 T.C. Number 16 (12/21/2009), where a taxpayer who had unfiled tax returns, established that he/she had an economic hardship, the Tax Court held that a proposed levy by the IRS was inappropriate given that under Internal Revenue Code Sec. 6343(a)(1)(D), the IRS must release a levy if an economic hardship is present. proceeding with an IRS Levy that would have to be immediately released constituted an abuse of discretion (Taxpayer Advocate Service - 2010 Annual Report to Congress). Internal Revenue Code Sec. 6343(a)(1)(D) states that a levy shall be released "if the Secretary has determined that such levy is creating an economic hardship due to the financial condition of the taxpayer."

Imagine that one day, you will wake up to find your bank account(s) seized by the IRS. That IRS will take every dime that they find in your account at that moment in time that the Levy hits your bank.
